After more than two years of contentious litigation, which included trips to the Western District of Missouri and the Bankruptcy Court for the District of Delaware, the Circuit Court of Jackson County, Missouri granted Plaintiff’s Motion for Final Approval of a Class Action Settlement in Borchers v. Xceligent, Inc.

McInnes Law LLC, Bell Law, LLC, and the Waddell Law Firm LLC filed the case in April 2017 on behalf of 543 Xceligent employees whose W-2 information was disseminated to a hacker. This involved a phishing attack in which the hacker used an email address manipulated to appear as if the CEO was requesting W-2 forms from an employee in human resources. 

The settlement, valued at approximately $1,642,600.00 to the class, includes cash payments to each employee of $1,000.00, reimbursement for up to $1,200.00 more for out-of-pocket expenses, and receipt of three years of premium identity theft and credit monitoring protection.
