Conditional Certification Granted in Werner Truck Driver Suit

The Claims

Plaintiff filed a nationwide class and collective action against Werner over its scheme to pass on its overhead costs to its truck drivers, deprive them of their minimum wages, and offload its aging fleet of trucks to unsuspecting drivers.

Status

After substantial briefing, which included objections to the magistrate judge’s report and recommendation, the court granted Plaintiff’s motion for FLSA conditional certification. Notice was mailed on December 16, 2020, and class members have until March 16, 2021 to join the action by submitting their consent forms.
